7. Limitation of Liability

7.2 Maximum Liability
IN NO EVENT SHALL PIZZA FACTORY'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE AND SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO PIZZA FACTORY IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).
7.3 Essential Basis
The limitations of liability set forth in this Section reflect a fair allocation of risk between you and Pizza Factory and are an essential basis of the bargain between the parties. These limitations will apply notwithstanding any failure of essential purpose of any limited remedy.

8.1 As-Is Basis
THE SITE AND ALL SERVICES PROVIDED BY PIZZA FACTORY ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PIZZA FACTORY EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE;
- WARRANTIES OF TITLE OR NON-INFRINGEMENT;
- WARRANTIES THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
- WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY CONTENT ON THE SITE.

For customers located in the State of California, these Terms are subject to the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), and other applicable California consumer protection laws.
Any legal action or proceeding arising out of or related to these Terms or your use of our services that is not subject to arbitration as described in Section 11 shall be brought exclusively in the federal or state courts of competent jurisdiction in the United States, and you hereby consent to the personal jurisdiction and venue of such courts.
You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to these Terms of Service must be filed within one (1) year after such claim or cause of action arose, or it will be forever barred.
11. Dispute Resolution
11.1 Informal Resolution
Before initiating any formal dispute resolution proceedings, you agree to first attempt to resolve any dispute informally by contacting Pizza Factory at [email protected]. We will attempt to resolve the dispute informally by contacting you via email within thirty (30) days of receiving your notice. If the dispute is not resolved within sixty (60) days of submission, either party may pursue formal dispute resolution as described below.
11.2 Binding Arbitration
EXCEPT FOR CLAIMS THAT QUALIFY FOR SMALL CLAIMS COURT, ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL BE RESOLVED BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (AAA) IN ACCORDANCE WITH ITS CONSUMER ARBITRATION RULES, RATHER THAN IN COURT.
The arbitration shall be conducted in the English language. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs the interpretation and enforcement of this arbitration provision.
11.3 Class Action Waiver
YOU AND PIZZA FACTORY AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. Unless both you and Pizza Factory agree in writing, no arbitrator or judge may consolidate more than one person's claims or otherwise preside over any form of a representative or class proceeding.
11.4 Small Claims Court
Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes or claims within the scope of that court's jurisdiction, provided that such action remains in small claims court and is not removed or appealed to a court of general jurisdiction.
11.5 Arbitration Fees
Payment of all filing, administration, and arbitrator fees will be governed by the AAA's Consumer Arbitration Rules. If you are unable to afford arbitration fees, you may request a fee waiver from the AAA in accordance with its procedures.
12. Term and Termination
12.1 Duration
These Terms of Service are effective as of the date you first access or use our Site or services and shall remain in full force and effect until terminated in accordance with this Section.
12.2 Termination by You
